Masci Bk.: 26573 <br /> (Owner of Record: Susan Masci) Pg.: 159 <br /> 6 Quaker Run Road <br /> (Map 83 Parcel 214) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 8,2019 by Frank Masci requesting Variance relief from <br /> the side yard setback under §174-31 of the Zoning Bylaws to allow for construction of a <br /> shed on property located in an R-3 Zoning District, at 6 Quaker Run Road, Map 83 Parcel <br /> 214, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 15, 2019 and November 22, 2019 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> January 8,2020 at which time the following members of the Board of Appeals were present <br /> and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ron Bonvie, Scott Goldstein, and Associate Member, Sharon Sangeleer. <br /> Mr. Masci represented himself for the Variance relief for his shed. He read a letter dated <br /> November 10, 2019 from the builder of his home. His builder recommended a specific <br /> location for the 16' x 26' shed because of the topography of the lot, and that the property <br /> boarders two roads. Mr. Masci also read letters of approval from his abutters. Mr. Masci <br /> said that the shed will be set on an angle, and only a corner of the shed will be within the <br /> 15 ft. setback but will still be 5 ft. from the property line. It's a heavily wooded area and <br /> he wants to keep the landscaping the same. <br /> The project will require a regular building permit because of the size of the shed and is <br /> required to be 15 ft. setback from the property line. However, there's a steep slope in the <br /> rear of the property which is considered a hardship under the Variance criteria. <br /> Sharon read the Conservation comments into the record. Charlie Maintanis said that the <br /> land will probably require to be excavated because there cannot be Sono tubes out of the <br /> ground. <br /> 1 <br />
