4.
Town Of Mashpee
16 Great Neck Road North
......... Massachusetts 02649
BOARD OF HEALTH - PUBLIC SESSION
Mashpee Town Hall — Ockway Meeting Room
Minutes of the Meeting of September 23, 2021
Board Members Present: Member Absent: Also Present:
Brian Baumgaertel, Chair Glen Harrington, Health Agent
Ernest Virgilio, Vice-Chair Christine Willander,Asst. Health Agent
Kripani Patel, Clerk
Chair Brian Baumgaertel called the Board of Health meeting to order at 6:00 PM.
OLD BUSINESS
1. 48 Tri-Town Circle. Mr. Harrington commented that, on September 23rd, the Assistant Health
Agent reached out to the occupant, Ms.Soldana, for a status update. Ms. Soldana reported that
Elder Services had been out to the property the day before, and had removed a full truckload of
furniture and boxes. She also stated that Elder Services advised her they would return the
following week to remove more items. The Assistant Health Agent inquired with Ms. Soldana
whether she had access to the stove for cooking, and the sink for preparing food, and she reported
that she did. The Assistant Health Agent inquired whether the area at the rear interior of the
dwelling had been cleared to the extent that occupants could exit safely through the slider, and
she reported that it had. Ms. Soldana had a doctor's note that she was willing to provide, which
excused her from having to attend this hearing. She agreed to contact this office for a follow-up
inspection after Elder Services visits her next week. Ms. Soldana's case worker at Elder Services
could not be reached in time to comment on this update. Mr. Harrington added that we haven't
pushed the issue to get into the house for an inspection because the occupant just had surgery.
There being no further comments or discussion, Kripani Patel moved to continue the matter at 48
Tri-Town until Health Agents have had an opportunity to re-inspect the property. Motion
seconded by Ernest Virgilio. Roll call vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian
Baumgaertel (yes). VOTE: Unanimous (3-0).
2. 97 Sunset Strip. Mr. Harrington commented that he spoke with the property owner on
September 10, 2021, who alleged that the problem is with her neighbor. She consistently
deflected and changed the subject, to the point that Mr. Harrington told her the Board would
have to issue a complaint in court and terminated the call. There was no commitment by the
property owner to do anything. Mr. Harrington recommended that the Board send this matter to
Town Counsel for collection of fines and issuance of a complaint in court. Board members agreed
that the property owner has had adequate opportunity to correct the violations.
1
