Town of Mashpee <br /> �r 16("neat Veck'1Opad a"Orlh <br /> l ashpee,_lassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO A <br /> WRITTEN FINDING (FINDING-2019-18) <br /> FINDING-2020-08 <br /> Karl Schneider and Doc.: 1341635 <br /> Jill Schneider Ctf.: 215582 <br /> 14 Nick Trail <br /> (Map 117 Parcel 241) <br /> Mashpee, MA 02649 <br /> A Petition was filed on January 13, 2020 by Owners, Karl and Jill Schneider requesting a <br /> Modification of an approved Written Finding (FINDING-2019-18) by removing the <br /> screened porch addition on property located in the Popponesset Overly District and R-3 <br /> Zoning District, at 14 Nick Trail, Map 117 Parcel 241, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter . <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 17, 2020 and January 24, 2020 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> February 12, 2020 at which time the following members of the Board of Appeals were <br /> present and acting throughout;Vice Chairman,William Blaisdell,Board Member,Norman <br /> J. Gould, and Associate. Members, Sharon Sangeleer, George Ganzenmuller, and James <br /> Reiffarth. <br /> Steve Cook, Cotuit Bay Design represented the petition for a modification. This project <br /> was approved at the hearings on March 27, 2019 for a new addition and screen porch on <br /> the right side of the existing house. The house is also in a flood zone, and would have to <br /> meet flood zone requirements. After pricing out the project, the addition and the screen <br /> porch are over 50%of the assessed market value of the house,and since it's in a flood zone <br /> would require lifting the house and pouring a new foundation, etc. The plan dated <br /> December 12,2018 shows the new addition with the screen porch,and the plan was revised <br /> January 15, 2020. The screen porch was removed from the project to drop the value below <br /> the 50%of the market value to eliminate the extra expense of bringing the house out of the <br /> flood zone. <br /> Steve said that the only change to the plan is the side yard setback was originally 25.5 ft., <br /> and it will be 35.5 ft. The house is still pre-existing non-conforming in the front. <br /> Sharon read the Conservation Comments into the record and was approved. <br /> 1 <br />
