McKee Ct£: #165600 <br /> 127 Sampsons Mill Road <br /> (Map 63 Parcel 30) <br /> Mashpee, MA <br /> A Petition was filed on January 30, 2020 by Owners, Steven and Diane McKee requesting <br /> a Variance from the side yard setback under §174-31 of the Zoning Bylaws to allow for <br /> construction of a shed on property located in an R-3 Zoning District, Map 63 Parcel 30, <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on February 21, 2020 and February 28, 2020. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,March <br /> 11, 2020 at which time the following members of the Board of Appeals were present; <br /> Chairman, Jonathan Furbush, Board Members, Ron Bonvie, Scott Goldstein, Associate <br /> Members Sharon Sangeleer; and James Reiffarth were present. Also present was Charlie <br /> Maintanis, Building Inspector. <br /> The Board reviewed the site plan and could not determine a hardship under the bylaws. <br /> Chairman Furbush and the other Board members mentioned that a smaller shed could be <br /> built, and moved 5 ft. away from the property line, or increase the size of the smaller <br /> existing shed. The bylaw states that a shed 120 sq. ft. or smaller can be 5 ft. from the <br /> property line, and a larger shed will require to be 15 ft. from the property line. After <br /> discussion, the Board requested that Mr. McKee submit a new site plan depicting the <br /> relocation and dimensions of the shed because the current plan cannot be approved. Mr. <br /> McKee requested a continuance based on the Board's recommendations. The Board <br /> accepted the applicant's continuance until March 25, 2020. <br /> The March 25, 2020 meeting was continued due to the pandemic until April 22, 2020. At <br /> which time Mr. McKee did not produce a revised site plan, and requested a further <br /> continuance until Wednesday, May 13, 2020. <br /> t <br />
