MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> James R. Sprezel <br /> 14 Bowsprit Toint(Map 105 Parcel 224) <br /> Mashpee, MA 02649 <br /> SP-2020-15 <br /> The lot itself is a combination of two lots shown on a couple of land court plans. The lot is <br /> just over 18,000 sq. ft. and was built back in the 1980's and currently has four bedrooms <br /> as shown on the photos provided. There is also a cabana that basically provided another <br /> bedroom. There is also an accessory pool and dock complex shown on the site plan. The <br /> new structure will contain four bedrooms but will not have a cabana. There will be an <br /> attached garage and swimming pool surrounded by patio blocks. <br /> The lot is situated in the R-3 Zoning District, and requires 40,000 sq. ft. of lot area, and <br /> 150 ft. of frontage. This lot is non-conforming because it does not meet those two criteria's, <br /> and in addition, it allows for a maximum lot coverage of 20% and a building height of 35 <br /> ft. Section 174-17.1 allows for a raze and replace project upon the grant of Special Permit <br /> relief by the Zoning Board of Appeals. The Board must find that there is no new non- <br /> conformities in connection with this project; that the proposed project is not substantially <br /> more detrimental to the neighborhood than the existing conditions, and there is sufficient <br /> land area for parking. The proposal also includes a garage, and currently there is no garage <br /> on site. The two non-conformities were eliminated. The dwelling will be setback the proper <br /> distance from the sidelines as well as the wetlands. The proposed lot coverage is 19.54% <br /> which is below the allowed 20%. The new construction will meet current day codes, and <br /> there is a new septic system that is part of this complete raze and replace project. The <br /> project has been approved by the Conservation Commission, and the Board of Health <br /> comments said that it requires approval by their department prior to issuance of a building <br /> permit. <br /> Tom Bunker said that the non-conforming side setback has been eliminated, as well as the <br /> rear setback to the wetlands.There will be a new septic system installed. The existing house <br /> did not conform to the FEMA regulations as far as building in a flood zone, and the new <br /> house will comply with FEMA regulations. <br /> GENERAL CRITERIA: <br /> The subject property located at 14 Bowsprit Point is approximately 18,100 square <br /> feet. <br /> There were no phone calls from abutters. <br /> 2 <br />
