Peck requesting a Variance under <br /> §174-33 of the Zoning Bylaws to allow for construction of timber access stairs within the <br /> setback to the wetlands on property located in an R-3 Zoning District, 1 Chestnut St.,Map <br /> 77 Parcel 38, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on July 3, 2020 and July 10, 2020 a copy of which is <br /> attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, July <br /> 22, 2020 as a remote meeting, at which time the following members of the Board of <br /> Appeals were present and acting throughout; Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Associate Member <br /> George Ganzenmuller. <br /> Mr. Mike Borselli, with Falmouth Engineering represented the applicant for the Variance <br /> request. The property is located on the corner of Quinaquisset Avenue and Chestnut Street. <br /> He provided the Board with the site plan that depicted a significant steep embankment that <br /> has the potential to erode, so the proposal is to install 4 ft. wide timber stairs to provide the <br /> applicant a safer way to access the dock complex. The plan also had a profile of the stairs <br /> and landing which will be constructed by hand. The reason for the application is that the <br /> stairs are being built within the saltmarsh, and required a Variance from the wetlands. The <br /> project was approved by the Conservation Commission and issued an Order of Conditions <br /> to install these stairs. <br /> Chairman Furbush said that this is similar to the property next door that the Board <br /> approved. He had no issues. <br /> Mr.Bonvie wanted to confirm that the relief requested is a 50 ft.variance from the wetlands <br /> resource area. <br /> 1 <br />
