MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Richard J. Cook and Diane E. Cook <br /> 19 Pem Lane (Map 89 Parcel 31) <br /> Mashpee, MA <br /> SP-2020-21 <br /> Mr. Kirrane suggested that the Board could issue a condition to satisfy the Board of Health <br /> upon granting relief that the space either be altered or eliminated so it does not qualify as <br /> a bedroom. <br /> Mr. Furbush asked if the cottage has its own septic system. Mr. Kirrane said no; it's <br /> connected to the septic system of the main residence. The hand-drawn plan depicted what <br /> looked like a leaching field, and that might have raised the question with the Board of <br /> Health if it was capable of accommodating two bedrooms. The Board of Health will only <br /> allow four bedrooms, and the house currently has three bedrooms. Mr. Kirrane said that <br /> the floor plan shows a loft and living space below with a bedroom. It would exceed the <br /> septic capacity if there were two bedrooms in this cottage structure. Mr. Furbush wanted <br /> to confirm that this cottage was not classified as an accessory apartment because there is <br /> currently only one bedroom. Mr. Kirrane said that is correct. He said this is simply a pre- <br /> existing non-conforming structure that is being razed and replaced,to become more livable <br /> compared to its current condition. Mr. Kirrane said there is currently a bathroom and one <br /> bedroom in this cottage. Mr. Kirrane also provided interior photos of the cottage showing <br /> its current condition. <br /> The Board had a discussion and determined that the cottage structure was in disrepair. <br /> Charlie Maintanis mentioned to Mr. Kirrane that it looked like a demolition had started on <br /> the cottage, and said a demo permit is required. A list of requirements can be obtained by <br /> the Building Department. <br /> Mr. Bonvie asked if the lot coverage was getting better or not changing. Mr. Kirrane said <br /> that the lot is currently 43,000 sq. ft., and the difference between what is there now is 762 <br /> sq. ft., reducing the size to.747 sq. ft. Given the size of the lot there is no issue. <br /> Charlie asked if there is a proposed deck for the cottage. Mr. Kirrane said the plan shows <br /> a proposed brick patio to be replaced by the concrete. <br /> Sharon read the Board of Health comments into the record, and Conservation approved the <br /> project. <br /> There were no more comments from the Board. There were no phone calls from abutters. <br /> GENERAL CRITERIA: <br /> The subject property located at 19 Pem Lane is approximately 43,000 sq. ft. square feet. <br /> There were no phone calls from abutters. <br /> 2 <br />
