<br /> SPECIAL PERMIT FINDINGS:
<br /> The Board had a discussion regarding the Variance request from the wetlands and
<br /> determined that is not necessary because the pre-existing non-conforming shed that is 24
<br /> ft. from the wetlands will be completely removed, and the Variance could be withdrawn
<br /> from the application. Attorney Kirrane agreed, but wanted the Special Permit application
<br /> request to include the proposed pool. The Board accepted the withdrawal of the Variance.
<br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Special
<br /> Permit. Upon motion duly made and seconded at the Public Hearings on Wednesday,
<br /> September 9, 2020, the Zoning Board of Appeals voted unanimously to issue a Special
<br /> Permit to Owner,Kim Sieurin of 424 Monomoscoy under §174.17.1 of the Zoning Bylaws
<br /> to raze and replace a three (3) bedroom non-conforming residential structure including a
<br /> pool on property located in an R-3 Zoning District, Map 124 Parcel 49, Mashpee; MA,
<br /> with the following conditions:
<br /> 1. The Board has determined that the applicant meets all the conditions of a Special
<br /> Permit under Mass General Law 40A Section 9.
