Sangeleer Doc.: 1336675 <br /> 10 Shorewood Drive Ct£: 214949 <br /> (Map 58 Parcel 32) <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 24, 2020 by Owner, Sharon Sangeleer requesting a Variance <br /> under §174-33 (Setback from wetlands) of the Zoning Bylaws to raze and replace a pre- <br /> existing, non-conforming single-family structure and deck on property located in an R-5 <br /> Zoning District, Map 58 Parcel 32, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on August 7, 2020 and August 14, 2020. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held (remote/virtual) on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 26, 2020 at which time the following members of the Board of <br /> Appeals were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Norman J. Gould, Scott Goldstein, and Associate <br /> Member, George Ganzenmuller. <br /> Attorney Michael O'Shaughnessy represented the raze and replace application for a Special <br /> Permit and Variance. Also present was Steve Cook, with Cotuit Bay Design. The existing <br /> site plan depicts a 624 sq. ft. house. The setback on the easterly side of the lot is currently <br /> 14.1 ft., and a distance of 56.4 ft. on the front yard setback, and a dimension of 16.4 ft. and <br /> 18.3 ft. from John's Pond to the concrete pad. <br /> The proposed house is approximately 1,500 sq. ft. with a deck in the rear. The house is <br /> shifting westerly toward John's Pond to increase the side yard setback to 16 ft. to make it <br /> more conforming with Zoning. The front yard setback is 48.1 ft. to the front steps and <br /> complies with Zoning, and the side and rear yard setbacks complies with Zoning. The <br /> Conservation Commission has no issues, and the Board of Health submitted comments <br /> relative to the demo permit. The reason for the Variance request is because the house is <br /> being shifted toward John's Pond to a dimension of 16 ft. The other reason is the stairway <br /> in the rear is within the 50 ft. buffer. The elevation on one side is 27 ft. and 32 ft. on the <br /> other side because of the grade change. This structure will result in an improvement to the <br /> lot, and is consistent with current Zoning. <br /> 1 <br />
