Bk.: 29541 <br /> Owner of Record: Evergreen Energy LLC Pg.: 136 <br /> Kailey and Adam Cullen <br /> 588 Main St. (31 Evergreen Circle) <br /> (Map 19 Parcel 10-10) <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 11, 2020 by Owners,Kailey and Adam Cullen, of the Cape <br /> Cod Dog Center, Inc. requesting a Modification to the existing Special Permits (SP-2018- <br /> 54) and (SP-2019-50) to allow for current plantings/ landscape plan in keeping with the <br /> reduction of the building size granted by the Zoning Board of Appeals on property located <br /> in an I1 Zoning District, at 31 Evergreen Circle, Map 19 Parcel 10-10), Mashpee, MA. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall as a virtual/remote <br /> meeting on Wednesday, September 9, 2020 at which time the following members of the <br /> Board of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Norman J. Gould, Scott Goldstein, and <br /> Associate Member, James Reiffarth <br /> Roy Catignani, Architect and Builder of the project represented the Owners, Kailey and <br /> Adam Cullen who were also present. The facility has been constructed and there is an <br /> occupancy permit. Roy said that the current matter dates back before he was involved in <br /> the project, and when an original special permit was given by the Board of Appeals. At the <br /> time, the building size was larger, and the anticipated revenue available for the building <br /> was larger.He subsequently presented a reduced size building plan to the Town and Zoning <br /> Board that was approved. On the final inspections by the Town Engineer, it was brought <br /> to their attention that there was a landscape plan submitted with the original application <br /> which was substantially different than the landscape plan intended for the reduced size <br /> building. They prepared a revised landscape plan and submitted that to Attorney, Kevin <br /> Kirrane, and it was a discussion at the August hearing. Since that time,they completed the <br /> loam and seeding of the lot, but has not yet installed the vertical plantings. The plan was <br /> again updated to include canine grass which is artificial turf located to the right and left of <br /> the building entrance. There is no irrigation installed. The revised plan will have less <br /> plantings than the plan that was submitted during the informal discussion. <br /> 1 <br />
