Town of Mashpee <br /> 16 Great M?ck load Jforth <br /> Alashpoe,Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2020-35 <br /> Petitioner: Mansoor Ahmad Java Bk.: 32005 <br /> d/b/a Wigwam Pantry Pg.: 40 <br /> 100 Great Neck Road North <br /> (Map 45 Parcel 3) <br /> Mashpee, MA 02649 <br /> (Owner of record: Juan Marichal, Trustee <br /> Of The River Bend Village Trust) <br /> A Petition was filed on August 11, 2020 by Petitioner, Mansoor Ahmad Java, d/b/a <br /> Wigwam Pantry requesting a Written Finding under §174-17 of the Zoning Bylaws to <br /> change a pre-existing, non-conforming use from a strip club/bar/restaurant to a <br /> convenience store in an area consisting of approximately 2,000 sq. ft. on property located <br /> in an R-5 Zoning District, Map 45 Parcel 3, Mashpee, MA. Owner of Record: Juan <br /> Marichal, Trustee of the River Bend Village Trust. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on August 21, 2020 and August 28, 2020. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall (virtual/remote) on <br /> Wednesday, September 9, 2020 at which time the following members of the Board of <br /> Appeals were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Attorney, Rob Mills represented the Owner, Juan Marichal, and also Mr. Java who intends <br /> to run the Wigwam Pantry. Mr. Java currently operates the Shell Gas Station and <br /> convenience store on Rte. 130. Mr. Java believes this location is well suited for several <br /> reasons, such as easy access, and easy egress, and will be well received by the public. He <br /> intends to provide coffee, soft drinks, groceries, lottery, but does not intend to offer <br /> prepared foods. He intends to be open between the hours of 6:00 am to 11:00 pm in the <br /> evening, seven days a week. The area for the store is the furthest most right portion of the <br /> building and consists of 2,000 sq. ft. <br /> 1 <br />
