• Any requirement for copies of deeds. This is municipally owned property, under tax <br /> foreclosure proceedings. <br /> ACTION: Waiver granted, after provision of the development agreement with MAHT and <br /> the deeds held by MART. <br /> • Any requirement for signatures by municipal officials to support the application being filed <br /> as the ZBA is the comprehensive permit granting authority. <br /> ACTION: Waiver granted, with copies of the Petition having been sent to all Local Boards. <br /> 3. Zoning Board of Appeals'Comprehensive Permit Rules <br /> As provided for under 760 CMR 56.02, 56.05 and 56.07(2)(4),the Applicant seeks a waiver from <br /> the application of any standard in the ZBA's Comprehensive Permit Rules("ZBA Rules")that is not <br /> applied equally to market rate developments, including, but not limited to the sections identified below. <br /> Under 760 CMR 56.02, 56.05 and 56.07(2)(4), Local Rules and Regulations shall be applied so as to be <br /> Consistent With Local Needs and shall be applied as equally as possible to subsidized and nonsubsidized <br /> housing. <br /> ACTION: The ZBA determines that its standards are equally applied and determines that <br /> this waiver is denied as not necessary. <br /> As provided for under 760 CMR 56.05,the Applicant also seeks a waiver from any standard in the <br /> ZBA Rules that is inconsistent with the requirement that the ZBA shall be the board to grant <br /> comprehensive permit relief and to grant waivers. <br /> ACTION: The ZBA determines that it is granting all required relief and waivers without <br /> delegating any action to any Local Board and, therefore,this waiver is denied as <br /> not necessary. <br /> The Applicant requested the following specific waivers from the ZBA Rules: <br /> • Section 3.01(g). A waiver is requested to the extent that this section requires any <br /> documentation as to project eligibility other than to present the Project Eligibility Letter <br /> issued by the Subsidizing Agency("PEL"). Under 760 CMR 56.04(1), project eligibility <br /> requirements"shall be established by issuance" of the PEL. <br /> ACTION: The ZBA is not requiring any documentation other than the PEL to determine <br /> project eligibility and,therefore, this waiver is unnecessary. <br /> 8 <br />
