MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />DECEMBER 9, 2020 <br /> <br />Sharon read the Board of Health comments into the record which stated that the applicant <br />has not submitted a filing with the BOH. <br /> <br />Mr. Furbush spoke to Glen Harrington, Board of Health Agent and said that he has not had <br />any conversations with the applicant since November 17, 2020. <br /> <br />Attorney Boudreau had Kyle Baker address the questions. Mr. Baker said he had some <br />meetings with the Board of Health regarding employee and consumer health and safety <br />matters in different local ordinances in conjunction with applications of cannabis <br />work is done with Mass Step, which discusses the local municipality odor ordinances, and <br />the local Department of Health approves or disapproves. So he will make sure that is done. <br />He was not at the Plan Review meeting on November 17, 2020. Attorney Boudreau said <br />that he was at the meeting along with Pat Casey, and Frank Ziano. <br /> <br />Attorney Boudreau said that the odor mitigation is a state-of-the-art, and they are very <br />confident that the Board of Health will be very satisfied, and are willing to go forward with <br />a contingency that they would have to approve it. <br /> <br />An applicant said that some of the key persons involved at the meeting had contracted <br />Covid-19, and were recently cleared this week. <br /> <br />Mr. Furbush will not approve anything, until the Board of Health is satisfied. He also asked <br />if anyone met with the Chief of Police. <br /> <br />Mr. Blaisdell said that the Board needs feedback from the Chief of Police, the Town <br />Manager, and they certainly need an in depth confirmation from the Board of Health. He <br />recommend that the applicant request a continuance until they can get confirmation from <br />all those departments. <br /> <br />Mr. Furbush stated that all departments need to be dealt with so that the Board can get <br />some positive feedback to be included in the final decision. He asked if anyone had any <br />questions. <br /> <br />Attorney Boudreau asked for a continuance until January 27, 2021. The issues are odor, <br />noise, and security and to make sure that the Fire Department, the Chief of Police and the <br />Town Manager, and the Board of Health have had a chance to have their concerns <br />addressed. <br /> <br />Mr. Furbush wants to receive something in writing from the respective departments that <br />they are satisfied. Mr. Goldstein made a motion to continue 14 Wags Road, Aspen Blue, <br />LLC request for modification of a Special Permit until January 27, 2021. Mr. Blaisdell <br />second, yes, Mr. Gould, yes, Mr. Goldstein, yes, Ms. Sangeleer, yes, and Mr. Furbush yes. <br />All were in favor to continue. <br /> <br />13 <br /> <br /> <br />
