Hodgson Pg.: 154 <br /> 17 Cedar St. <br /> (Map 77 Parcel 37) <br /> Mashpee, MA 02649 <br /> A Petition was filed on October 26, 2020 by Owners, George L. and Kathleen J. Hodgson <br /> requesting a Variance under §174-33 of the Zoning Bylaws to allow for construction of an <br /> elevated stairway to a dock situated within the wetlands resource area on property located <br /> in an R-3 Zoning District, Map 77 Parcel 37, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 13, 2020 and November 27, 2020. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 9, 2020 as a virtual remote meeting at which time the following members of the <br /> Board of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> GENERAL CRITERIA: <br /> The subject property located at 17 Cedar St. is approximately 38,988 square feet. <br /> There were no abutter phone calls. <br /> Wayne Tavares, Landscape Architect represented the applicants. This project was before <br /> the Board a year ago for the same Variance request that involved the required 50 ft. setback <br /> from the wetlands. The owners decided to modify their project for a simpler stairway. The <br /> Board approved the project a year ago,but the Variance expired. Mr. Tavares provided the <br /> Board with a revised site plan that depicts the location of the approved elevated walkway <br /> in a more desirable location that it is expanding from a brick patio adjacent to the pool and <br /> patio area down the embankment to the dock that was approved and licensed by the State. <br /> 1 <br />
