MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Suzanne M. McCartney and Kevin G. McCartney <br /> 29 Melissa Avenue (0 Melissa Avenue) <br /> (Map 21 Parcel 7B) Mashpee, MA 02649 <br /> SP-2020-48 <br /> The project was approved by the Conservation Commission. The site plan showed very <br /> mature trees that are situated on the lot, and in an effort to save those trees, the work <br /> requires negotiating to work around those trees to locate the platform and stairway that will <br /> be closer to the property line. Given the width of the lot, it would not comply with the <br /> current setback requirements of 30 ft., and the lot is only 20 ft. wide. <br /> GENERAL CRITERIA: <br /> The subject property located at 0 Melissa is approximately 11, 800 square feet. <br /> The Conservation Department and the Building Inspector comments were read into record. <br /> There were no abutter phone calls. <br /> SPECIAL PERMIT CRITERIA: <br /> Article VI—Land Use Regulations <br /> §174-25 (H) (7); Private one or two-car garage, greenhouse, or dock as a principle use <br /> where the lot cannot be developed with a principle residential use, provided that there be <br /> no commercial use or storage, no sanitary facilities, no storage outside of buildings, that <br /> no structure exceed fifteen (15) feet in height and that all applicable setbacks and lot <br /> coverage requirements are met and approved,that a Special Permit for such use is approved <br /> by the Board of Appeals. <br /> SPECIAL PERMIT FINDINGS: <br /> The Board determined the following; <br /> • The wooden stairs, platform, and dock complex will provide safe access to <br /> Mashpee Pond. <br /> • The 8 ft. x 12 ft. shed is 5 ft. from the property lot line. <br /> • The use will not be substantially more detrimental to the neighborhood. <br /> In view of the foregoing,the Board determined the Petitioners met the criteria for a Special <br /> Permit. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> December 9, 2020, the Zoning Board of Appeals voted unanimously to issue a Special <br /> Permit to Suzanne M. and Kevin G. McCartney under §174-25 (H) (7) to allow for <br /> construction of stairs, platform, and dock complex on a vacant parcel of land on property <br /> located in an R-5 Zoning District, at 0 Melissa Avenue, Map 21 Parcel 713, Mashpee,MA, <br /> with the following conditions; <br /> 2 <br />
