<br /> <br /> <br /> <br />MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />DECEMBER 9, 2020 <br /> <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, December 9, <br />2020, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road <br />North. Chairman, Jonathan D. Furbush, Board Members William A. Blaisdell, Ronald <br />Bonvie, Scott Goldstein, Norman J. Gould and Associate Members Sharon Sangeleer and <br />Jim Reiffarth were present. <br />NEW HEARINGS <br /> <br />Chairman Furbush opened the meeting at 6:00 pm and announced that the hearings were <br />being televised live on Mashpee TV as a virtual remote meeting. He will take public <br />comments after each hearing. <br /> <br />17 Cedar Street: Owners, George L. and Kathleen J. Hodgson request a Variance under <br />§174-33 of the Zoning Bylaws to allow for construction of an elevated stairway to a dock <br />situated within the wetlands resource area on property located in an R-3 Zoning District, <br />Map 77 Parcel 37, Mashpee, MA. <br /> <br />Wayne Tavares, Landscape Architect represented the applicants. This project was before <br />the Board a year ago for the same project that involves the required 50 ft. setback from the <br />wetlands. The owners decided to modify this project for a simpler stairway. The Board did <br />approve the project a year ago, but the issued Variance expired. He provided the Board <br />with a site plan that depicts the location of the approved elevated walkway in a more <br />desirable location that it is expanding from a brick patio adjacent to the pool and patio area <br />down the embankment to the approved licensed dock that was approved by the State. <br /> <br />A mitigation plant was given to Conservation because there is some disturbance around <br />the ground area. The old stairway is much closer to the property line, but it did not encroach <br />on the setbacks. The setback is 68.5 ft. and 57.43 ft. The dock is in the same location, the <br />only change is the walkway. <br /> <br />Chairman Furbush asked if the dock was built. Mr. Tavares said; no, the license was <br />submitted, and the dock will be built this winter along with the elevated walkway if <br />approved. Jonathan also asked who owned the adjacent Parcel D noted on the plan. Wayne <br />said he did not know, but that area under the dock is a paper road. Jonathan wants to know <br />who owns that just for his information. <br /> <br />Mr. Bonvie asked what would be the extent of the Variance request if a motion was made <br />to approve. The whole structure is within the wetlands, so it would be a 50 ft. Variance. <br />Mr. Blaisdell agreed. There were no more comments from the Board. <br /> <br />1 <br /> <br /> <br />
