Studley Pg.: 716 <br /> 50 Bayview Road <br /> (Map 119 Parcel 50) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 2, 2020 by Petitioner, Rolland Zeleny requesting a <br /> Special Permit under§174-17.1 to raze and replace a garage and residential camp structure <br /> with a new code compliant home and state of the art septic system on property located in <br /> an R3 Zoning District, at 50 Bayview Road,Map 119 Parcel 50, Mashpee, MA, (Owner of <br /> record: Dorothy G. Studley). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 13, 2020 and November 20, 2020. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 9,2020 as a virtual remote meeting at which time the following members of the <br /> Board of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> Attorney, Kevin Kirrane represented the Petitioner for the raze and replace project. There <br /> are two structures that exist on this 17,289 sq. ft. lot with approximately 84 ft. of frontage <br /> on Bayview Road. The lot is non-conforming because the R-3 district calls for 40,000 sq. <br /> ft. and 150 ft. of frontage. <br /> The property has been developed with a garage structure and a camp building that was built <br /> pre-1940.The existing garage was built in the 1980's.The property is bordered on the West <br /> by Hamblin Pond. The existing camp structure is non-conform because it sits 13 ft. from <br /> the edge of the saltmarsh and fails to meet the 50 ft. setback criteria from the wetlands. The <br /> existing garage structure is only 29.3 ft. from Bayview Road and is also non-conforming <br /> because of the required 40 ft. <br /> 1 <br />
