MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />DECEMBER 9, 2020 <br /> <br />Jonathan read an email dated December 9, 2020 into the record from Charlie Maintanis, <br />Building Inspector. <br /> <br />Attorney Kirrane said that the request for relief is 8.5 ft. from the Northerly property line <br />would require a Variance of 6.5 ft., and the boardwalk is 5.5 ft. from the Southerly side <br />line, and 9.5 ft. side yard setback. The platform would require setback relief of 6 ft. from <br />the rear of the mean high water. Mr. Kirrane said that it is up to the Board to decide if relief <br />is warranted for lot size because this is not a buildable lot. The Board determined that <br />68,200 sq. ft. would be the relief for the lot size. <br /> <br />Mr. Bonvie made a motion that the Board issue a Special Permit to Suzanne M. and Kevin <br />G. McCartney under §174-25 (H) (7) to allow for construction of stairs, platform, and dock <br />complex on a vacant parcel of land on property located in an R-5 Zoning District, Map 21 <br />Parcel 7B, Mashpee, MA with the following conditions; <br /> <br />1. The Board has determined that the applicant meets all the conditions of a Special <br />Permit under Mass General Law 40A Section 9. <br /> <br />2. Site Plan: Prepared for: Suzanne M. McCartney, 29 Melissa Avenue, Mashpee, <br />MA. Project: 0 Melissa Avenue, Mashpee, MA.
