Flaherty Ctf.: 174358 <br /> 10 Rock Island Road <br /> (Map 123 Parcel 23) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 21, 2020 by Owners, Gerard M. Flaherty and Linda S. <br /> Flaherty requesting a Special Permit under §174-17.1 of the Zoning Bylaws to raze and <br /> replace an existing non-conforming single family residence on property located in an R-3 <br /> Zoning District, 10 Rock Island Road, Map 123 Parcel 23, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 8, 2021 and January 15, 2021. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> January 27, 2021 as a virtual remote meeting at which time the following members of the <br /> Board of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> Attorney Kevin Kirrane represented the Flaherty's for the raze and replace application. A <br /> site plan provided by BSS Design and shows both the existing and proposed conditions on <br /> this lot. The lot is a 6,000 sq. ft. and is non-conforming with 50 ft. of frontage along Rock <br /> Island Rd.They also have title to a 3,000 sq. ft.lot primarily for parking.The lot is bordered <br /> by both Rock Island Road and Huckleberry Lane but there is no road lying between this <br /> road and the one next door. There is certain setback criteria that makes this dwelling non- <br /> conforming as to the setback from Rock Island Road. This building was built in the 1950's. <br /> The required setback is a 40 ft. from Rock Island and from Huckleberry, but the building <br /> is about 4 ft. from Rock Island, and 4.6 ft. from Huckleberry Lane. It fails to meet the side <br /> yard setback at 10.9 ft. The only conforming condition is that it conforms to the rear yard <br /> criteria but also exceeds the 20% lot coverage criteria at 25.45%. <br /> 1 <br />
