Burke and Katherine M. <br /> Burke, Trustees requesting a Special Permit under §174-25 (H) (7) of the Zoning Bylaws <br /> to allow for construction of a stairs and platform for use in connection with a ramp and <br /> float complex on property located in an R-3 Zoning District, AT 23 Monomoscoy Road <br /> West, Map 114 Parcel 8, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 8, 2021 and January 15, 2021. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> January 27, 2021 and continued to March 10, 2021 as a virtual remote meeting, at which <br /> time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, Ron <br /> Bonvie, Scott Goldstein,Norman J. Gould. <br /> Attorney Kevin Kirrane represented the applications for the homeowners who are <br /> proposing to construct a platform stairway with a removable ramp which will attach to the <br /> bottom anchored l0A float that is licensed by the Harbormaster. They have a dwelling that <br /> is across the street from this parcel, and they have had a mooring in the pond for several <br /> years. <br /> At the last meeting, the Board questioned whether or not they had the authority to grant <br /> Variance relief in connection with these type of applications. Chairman Furbush had <br /> consulted with the Town Planner, and it was determined and confirmed that these <br /> applications are within the prevue of the Board. <br /> 1 <br />
