Burke, Trustees Pg.: 73
23 Monomoscoy Road West
(Map 114 Parcel 8)
Mashpee, MA 02649
A Petition was filed on December 21, 2020 by Owners, Sean B. Burke and Katherine M.
Burke, Trustees requesting a Variance under §174-31 of the Zoning Bylaws to vary the
rear and front setbacks to allow for construction of a platform and stairs for a float complex
on property located in an R-3 Zoning District, at 23 Monomoscoy Road West, Map 114
Parcel 8, Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter
40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general
circulation in the Town of Mashpee, on January 8, 2021 and January 15, 2021.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of
Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws.
Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,
January 27, 2021 and continued to March 10, 2021 as a virtual remote meeting, at which
time the following members of the Board of Appeals were present and acting throughout;
Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, Ron
Bonvie, Scott Goldstein,Norman J. Gould.
Attorney Kevin Kirrane represented the applications for the homeowners who are
proposing to construct a platform stairway with a removable ramp which will attach to the
bottom anchored l0A float that is licensed by the Harbormaster. They have a dwelling that
is across the street fiom this parcel, and they have had a mooring in the pond for several
years.
At the last meeting, the Board questioned whether or not they had the authority to grant
Variance relief in connection with these type of applications. Chairman Furbush had
consulted with the Town Planner, and it was determined and confirmed that these
applications are within the prevue of the Board.
The application is a request for a Special Permit to construct an accessory use that is on a
lot that cannot be developed for single-family use, and is specifically allowed under §174-
24 (C). There is also a request for Variance relief because of its location for the purpose of
crossing into the wetland area in order to access the bottom anchored float.
1
