MASHPEE ZONING BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT/MODIFICATION Petitioner, Cape Cod Gutter Monkeys, LLC (Owner of Record: Evergreen BAND, LLC) 20 Evergreen Circle (Map 19 Parcel 10-2) Mashpee, MA 02649 SP-2021-30 The applicant has applied for a Special Permit under §174-24 C, §174-25 G (6), which is the contractor bay and §174-25 D (1)for office use. The Board must find that the proposed development and use will not adversely affect public health and safety concerns. Chairman Furbush reviewed the bylaws under §174-24 (C) 2 that mention health and safety. He asked if there will be storage of chemicals, or any other hazardous material. Attorney Kirrane said that the business will consist of storage of materials, and office use. There will be no hazardous waste or storage of chemicals on the site. All drainage of surface water will remain onsite, and a storm water report was provided by Dan O'Jala. There will be very few vehicles inside the building. There will be a very expensive truck that has special equipment for the use of fabrication and installation of gutters. The plans were approved by both Design and Plan Review. Dan O'Jala, said there are 23 parking spaces provided,and one van accessible handicapped space. The Board of Health approved the plan back in 2019. The area on the plan that is dark green is natural vegetation, and will provide enough natural buffer for the site. The Board of Health comments dated April 27, 2021 were read into the record. There were no more comments from the Board. There were no abutter phone calls. In view of the foregoing, the Board determined the Petitioner met the criteria for a Special Permit/Modification. Upon motion duly made and seconded at the Public Hearings on Wednesday, April 28, 2021, the Zoning Board of Appeals voted unanimously to issue a Special Permit/Modification to Petitioner, Cape Cod Gutter Monkeys, LLC under Zoning Bylaws §174-24 C, §174-25 G (6), Warehouse, and §174-25 D (1) Office to allow for construction of a 7,300 sq. ft. commercial building for storage and office use together with accessory parking, on property located in the I-1 and Light Industrial Overlay District(s), at 20 Evergreen Circle,Map 19,Parcel 10-2,Mashpee,MA,with the following conditions: 1. The Board has determined that the applicant meets all the conditions of a Special Permit under Mass General Law 40A Section 9. 2. Site Plan: 20 Evergreen Circle, Mashpee, MA, Prepared for Capewide Construction/Evergreen Band, LLC, Date: March 1, 2021, Revised: March 25, 2021 (Rotate Sign), Scale: 1" = 20', Sheet 1 of 2.
