�f •°�UtiTown of Mashpee <br /> y' 16 Great A(!k Yoad Xorth <br /> Maslipee,Alassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2021-32 <br /> Evergreen Energy, LLC Bk.: 29541 <br /> 41 Evergreen Circle Pg.: 136 <br /> (Map 19 Parcel 10-9) <br /> Mashpee, MA 02649 <br /> A Petition was filed on April 1, 2021 by Petitioner, Evergreen Energy, LLC requesting a <br /> Special Permit under §174-25 G(13)of the Zoning Bylaws to allow for a contractor's yard <br /> on property located in the I-1 and Light Industrial Overlay District(s), at 41 Evergreen <br /> Circle, Map 19 Parcel 10-9, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on April 2, 2021 and April 9, 2021. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall as a virtual remote <br /> meeting on Wednesday, April 28,2021 at which time the following members of the Board <br /> of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman,William Blaisdell, Board Members, Scott Goldstein, and Norman J. Gould, and <br /> Associate Member, Charlie Reidy. <br /> Attorney Christopher Kirrane represented the petitioners Peter and Mark Govoni, who are <br /> the Owners of the property. Also present was Raul Lizardi-Rivera, with Cape & Islands <br /> Engineering. The two applications (30 and 41 Evergreen), are similar for use as <br /> contractor's yards, which is an allowed use in the Industrial District with a Special Permit. <br /> The owners are in the site clearing business, and are requesting permission for storage of <br /> heavy machinery equipment,earth materials,and construction type vehicles. The materials <br /> stored onsite are woodchips, logs, and natural earth material; all which are allowed in this <br /> Industrial Zone. <br /> Chairman Furbush asked if there are any proposed buildings going on these lots. Attorney <br /> Kirrane said; no, but there is a shed that already exists on Lot 8 (30 Evergreen Circle). <br /> 1 <br />
