Bk.: 33129 <br /> (Owner of Record: Chapter Closed LLC) Pg.: 293 <br /> 40 Evergreen Circle <br /> Map 19, Parcel 10 <br /> Mashpee, MA 02649 <br /> A Petition was filed on April 14, 2021 by Petitioner, Pastore Excavation, Inc., requesting <br /> a Special Permit under §174-25 G (13), and §174-24 C of the Zoning Bylaws to allow for <br /> a contractor's yard on property located in the I-1 and Light Industrial Overlay District(s), <br /> at 40 Evergreen Circle, Map 19 Parcel 10-4, Mashpee, MA (Owner of Record: Chapter <br /> Closed, LLC). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on April 30, 2021 and May 7, 2021. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall as a virtual remote <br /> meeting on Wednesday, May 26, 2021 at which time the following members of the Board <br /> of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> Attorney, Kevin Kirrane represented Pastore Excavation Inc., who is seeking a Special <br /> Permit to allow for operation of a contractor's yard at 40 Evergreen Circle. Also present <br /> was Mike McGrath, with Holmes and McGrath Inc. The lot is located at the end of a cul- <br /> de-sac in the I1 Zoning District. The lot consists of 43,329 sq. ft., and has over 200 ft. of <br /> frontage along Evergreen Circle. The parcel is relatively flat and has a minimal amount of <br /> vegetation except around the parameters on a portion of the lot. <br /> The applicant seeks to occupy the site as a contractor's yard. It will be used primarily as a <br /> site to park construction vehicles and used in connection with the applicant's excavation <br /> business. There is no proposed building to be constructed on the site. The plan submitted <br /> by Mike McGrath shows that all surface water will remain on the site by a sophisticated <br /> grading and drainage system. There will be ten (10) paved parking spaces that are part of <br /> the proposal, and the site plan was reviewed and recommended by the Plan Review <br /> Committee. <br /> 1 <br />
