MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Petitioner, Pastore Excavation, Inc. <br /> (Owner of Record: Chapter Closed LLC) <br /> 40 Evergreen Circle (Map 19 Parcel 10) <br /> Mashpee, MA 02649 <br /> SP-2021-34 <br /> GENERAL CRITERIA <br /> The subject property located at 40 Evergreen Circle is approximately 43,329 square feet. <br /> There were no abutter phone calls. <br /> SPECIAL PERMIT FINDINGS <br /> The Board had a discussion regarding the site construction details, and the design <br /> engineering of the property. They determined that the design engineer should be <br /> responsible for the site inspections of the property, and provide a letter with their stamp to <br /> the Building Commissioner that all construction has been in accordance with the approved <br /> plans and specifications. <br /> The DPW recommendations were read into the record that were discussed at the Plan <br /> Review Committee Meeting on April 6, 2021. <br /> SPECIAL PERMIT CONDITIONS <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Special <br /> Permit. Upon motion duly made and seconded at the Public Hearings on Wednesday, May <br /> 26, 2021 the Zoning Board of Appeals voted unanimously to issue a Special Permit to <br /> Petitioner, Pastore Excavation, Inc., under §174-25 G (13), and §174-24 C of the Zoning <br /> Bylaws to allow for a contractor's yard on property located in the I-1 and Light Industrial <br /> Overlay District(s), at 40 Evergreen Circle, Map 19 Parcel 10-4, Mashpee, MA(Owner of <br /> Record: Chapter Closed, LLC), with the following conditions: <br /> 1. The Design Engineer whose stamp appears on the petition plan conducts his own <br /> site inspections, and submits a letter to the Building Commissioner certifying with <br /> his stamp that all construction has been in accordance with the approved plans and <br /> specifications. <br /> 2. The site plan as depicted on page 1 of page 3 will include additional plantings along <br /> the frontage, and the westerly lot line which includes 6 ft. tall arborvitaes 6 ft. on <br /> center. The Board acknowledged that there are some plantings on the westerly lot <br /> line but requires 6 ft. arborvitaes, 6 ft. on center. <br /> 3 <br />
