MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />OCTOBER 13, 2021 <br />3. The Board issues a setback from wetlands coastal bank under § 174-33 in the <br />amount of 38 ft. <br />4. Conditioned on all Town Department comments read into the record. <br />5. Conditioned that if the Board of Health approves a new septic design, any changes <br />to that plan will be require the applicant to return to the Zoning Board of Appeals <br />for approval. <br />6. Conditioned that the average natural grade must be noted on the building plans and <br />showing the height of the building. <br />7. Conditioned that no landscape plan or retaining walls will be approved at this time. <br />8. Conditioned that if Conservation approves a plan with retaining walls the applicant <br />will be required to return to the Zoning Board of Appeals for approval. <br />Mr. Gould, seconded, yes <br />Ms. Sangeleer, yes, <br />Mr. Ganzenmuller, yes, <br />Mr. Goldstein, yes, <br />Mr. Bonvie, yes. <br />All were in favor to approve the Special Permit relief. <br />14 Pine Avenue: Petitioner, Chris Childs, Patriot Builders requests a Special Permit under <br />§174-17.1 of the Zoning Bylaws to raze and replace a pre-existing non -conforming <br />residential structure, (existing foundation to remain) on property located in an R-3 Zoning <br />District, Map 123 Parcel 40, Mashpee, MA. (Owner of record: Christopher M. DeSantis <br />and Laurie A. Stucchi). (Continued from September 22, 2021 hearings at the request of <br />the applicant). <br />Sharon read a letter request for continuance from Chris Childs dated October 5, 2021 until <br />October 27, 2021 to allow more time to allow for the Board of Health approval process and <br />update the proposed plan. <br />Mr. Bonvie made a motion that the Board approve a letter from Chris Childs referencing <br />14 Pine Avenue requesting a continuance until October 27, 2021. Mr. Gould seconded. All <br />were in favor. <br />49 Fells Pond Road: Owners, Richard J. and Janet E. Weishaus request a Written Finding <br />under §174-17 of the Zoning Bylaws to allow for an addition, extension of a pre-existing <br />non -conforming single family dwelling on property located in an R-3 Zoning District, Map <br />116 Parcel 9, Mashpee, MA. <br />3 <br />
