MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MAY 12, 2021 <br /> Mr. Furbush would like to establish guidelines when a peer review is necessary. Ron <br /> agreed. Every motion should have a line item for example; "prior to occupancy that the <br /> design engineer must sign an affidavit that the work is in compliance with the plan". Ron <br /> asked if the ZBA could utilize the Planning Board's consulting engineer, or does peer <br /> review require two or three bids from other outside companies? <br /> Evan said when the ZBA makes a motion, do not specifically name a consulting engineer <br /> because they may not have the capacity to provide the inspections for a peer review. They <br /> might be too busy. He suggested that the ZBA work with the Planning Board's consultant, <br /> but he is not obligated to do so. <br /> Ron asked if the ZBA wanted to have peer review would the motion be; "the applicant will <br /> seek a dollar figure from the consulting engineer. The applicant will put into an account <br /> those amount of dollars, and will seek and obtain a peer review from said consulting <br /> engineer. Or would the ZBA require to find two or three other people and quotes. These <br /> peer reviews can be expensive. <br /> Evan said that the ZBA can initiate the first, so long as the peer review is less than$10,000. <br /> There are short term solutions, but the long term solution might be to change the bylaw to <br /> allow the ZBA to have its own consultant, or to modify the fees. In the interim, I would <br /> suggest that the Board to follow the steps that were discussed earlier. <br /> Mr. Furbush believes it's a good idea what Evan suggested earlier for the smaller projects <br /> to have the designing engineer submit a letter to the Building Commissioner certifying with <br /> his stamp that all the construction has been done in accordance with the approved plan with <br /> their stamp. This would solve the issue of requiring an extra month and a half review, or a <br /> requirement that the designing engineer conduct, submit inspections, and witness critical <br /> aspects of the engineering, or condition the approval upon site inspections by a third party <br /> consultant that the Board would obtain quotes for and paid by the applicant. <br /> Charlie commented that similar to what Ron had mentioned that a condition relative to <br /> every approval that at the end of the project and prior to occupancy:there will be peer <br /> review by the designer that the work done conforms to the plans submitted and approved. <br /> Evan suggested that the motion made should also contain a condition that the applicant <br /> submit an as-built before the certificate of occupancy so that if there are any changes made <br /> submitted to the office. Ron said that the peer review also expecting those as-builts. <br /> Mr. Furbush said that any time the ZBA asks for a peer review it would be to continue the <br /> hearing, but if it's a small project to have the engineer to sign off that the project was done <br /> correctly. Evan said that this is up to the discretion of the Board. Do not approve the plans <br /> if you want a peer review. <br /> Jim Reiffarth'commented that a peer review depends on the size of the project. He agreed <br /> that a certification can be submitted that the project was built as designed. <br /> 5 <br />
