MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> July 28, 2021 <br /> 114 and 118 Ninigret Avenue: Petitioners, Brian and Stephanie Schwartz request an <br /> Appeal of the Building Official's Decision under M.G.L. 40A §§8 and 15 and under <br /> M.G.L. 40A §6 that 114 Ninigret Ave, (lots 1105, 1106 & 1107)has merged with abutting <br /> property 118 Ninigret (Lots 1108 and 1109), and that the septic system servicing the <br /> dwelling is required to be on the same lot as the dwelling. (Owner of Record: Susan and <br /> Russell McDonald). <br /> Sharon read a formal letter of withdrawal from Attorney Kirrane dated July 28, 2021. <br /> Attorney Kirrane made a continent that there was a request relative to the location of the <br /> septic system on the property that is not the property that services the house. The Building <br /> Department was incorrect in that determination and it has since been clarified by the Board <br /> of Health that a septic system can be located on a lot other than the lot that particularly <br /> services the house. His letter still stands. <br /> Mr. Bonvie made a motion to accept Attorney Kevin Kirrane's letter dated July 28, 2021 <br /> in reference to 114/118 Ninigret Avenue for permission to withdraw the appeal application <br /> without prejudice. Mr. Gould seconded, yes, Mr. Reidy, yes, Mr. Bonvie, yes, Mr. <br /> Blaisdell, yes, and Mr. Furbush, yes. All were in favor to the withdrawal. <br /> 18 Grand Vista Drive: Petitioner, Dan Marsters requests a Variance of the front yard <br /> setback under §174-31 of the Zoning Bylaws to allow for construction of a single family <br /> dwelling on property located in an R-3 Zoning District,Map 69 Parcel 168, Mashpee,MA. <br /> (Owner of Record: Southworth Mashpee Properties LLQ. (Received a letter dated July <br /> 20, 2021 front the applicant requesting a withdrawal). <br /> Sharon read a formal withdrawal email into the record dated Tuesday, July 20, 2021 from <br /> Dan Marsters. <br /> Mr. Bonvie made a motion that the Board accept the email from Joyce Marsters request for <br /> withdrawal for 18 Grand Vista Drive, signed by Dan Marsters, Mr. Gould seconded, yes, <br /> Sharon, yes, Mr. Bonvie, yes, Mr. Blaisdell, yes, and Mr. Furbush, yes. All were in favor <br /> of the withdrawal. <br /> OTHER BUSINESS <br /> ➢ Approve July 14, 2021 meeting minutes. <br /> Sharon made a motion, and moved to approve the meeting minutes.
