Nichols Ct£: 206005 <br /> 164 Ninigret Avenue <br /> (Map 65 Parcel 85) <br /> Mashpee, MA 02649 <br /> A Petition was filed on June 25, 2021 by Owners,David W.Nichols and Debra L.Nichols <br /> requesting a Written Finding under§174-17 of the Zoning Bylaws to allow for construction <br /> of a second floor addition to a pre-existing, non-conforming single family residence on <br /> property located in an R-3 Zoning District, at 164 Ninigret Avenue, Map 65 Parcel 85, <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on July 30, 2021 and August 6, 2021 a copy of which <br /> is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> September 8, 2021 at which time the following members of the Board of Appeals were <br /> present and acting throughout;Chairman,Jonathan Furbush,Board Members,Ron Bonvie, <br /> Scott Goldstein, and Norman J. Gould, and Associate Member Sharon Sangeleer. <br /> Attorney Kevin Kirrane represented the owners for the Written Finding request. He <br /> provided his written presentation that included the site plan and photos of the existing <br /> conditions. The property is a non-conforming lot consisting of approximately 7,400 sq. ft., <br /> and 6,250 sq. ft. which is upland. The site is bounded on two sides by a street or a way, <br /> however, the way to the West, Sakonnet Drive which boarders John's Pond and other <br /> properties are utilized by most of the property owners.That street has never been developed <br /> and suspects it will never be developed. <br /> The parcel slops significantly from East to West as it drops toward Sakonnet Drive and <br /> John's Pond. The existing structure is a single-story ranch style home with a walk-out <br /> basement and a first floor deck. The structure is non-conforming as it fails to meet the <br /> existing front yard setback requirements from Ninigret Ave., and the side yard setback. <br /> 1 <br />
