Tuttle, Trustees <br /> 41 Mercantile Way (Map 88 Parcel 87) <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 19, 2021 by Petitioner, Capewide Construction, Inc. <br /> requesting a Special Permit under §§174-24 (C), 174-25 G (4), (6), (14), and §174-41 (M) <br /> of the Zoning Bylaws to allow for construction of an eight (8) contractor bay warehouse <br /> on property located in an 1-1 and Light Industrial Overlay Zoning District,at 41 Mercantile <br /> Way, Map 88 Parcel 87, Mashpee, MA. (Owner of Record: Tuttle Joint Trust, Timothy E. <br /> and Cheryle R. Tuttle, Trustees). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on August 27, 2021 and September 3, 2021 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> September 22, 2021 at which time the following members of the Board of Appeals were <br /> present and acting throughout; Acting Chairman, Ron Bonvie, Board Member, Scott <br /> Goldstein, and Associate Members, Sharon Sangeleer, George Ganzenmuller, and Charles <br /> Reidy. <br /> Attorney Kevin Kirrane represented the Special Permit request to construct and to use an <br /> industrial building situated at 41 Mercantile Way. This project is similar to other projects <br /> that have been presented to the Board by Capewide Construction in the past. Also present <br /> was Joao Junqueira, Principal of Capewide, and a representative with Down Cape <br /> Engineering who has prepared the engineering plan in connection with this project. <br /> The site is a 64,000 plus square foot lot. The proposal is to construct a 9,972 sq. ft.building <br /> on this lot that will accommodate eight contractor bays of equal size as shown on the plan. <br /> The building plan shows the exterior garage doors as well as a small mechanical room on <br /> the South elevation of the building. The other side shows pedestrian access doors. There is <br /> an interior floor plan that shows the eight contractor bays that have been applied for under <br /> the terms and conditions of the permit. <br /> 1 <br />
