MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 10, 2021 <br /> Mr. Goldstein questioned the amount of bedrooms. The current structure is 2-bedrooms, <br /> and the proposed is 3-bedrooms. <br /> Mr. Furbush polled the Board for any comments or questions. <br /> Sharon read the Conservation Commission and the Board of Health comments into the <br /> record. <br /> The Board had a discussion regarding the new dwelling setback from the wetlands. The <br /> Board also discussed the 6 ft. opening requirements on the first floor. <br /> Mr. Morris questioned the retaining walls that are located beyond the 50 ft. setback to the <br /> wetlands. The stairs were corrected but the retaining walls go beyond the requirement. He <br /> is fine if the walls are 4 ft. <br /> Mr. Goldstein commented that as one member he does not see a problem with the retaining <br /> walls because of the slope. <br /> Sharon read the direct abutter letter into the record explaining her concerns with proposed <br /> mechanicals that will be installed. <br /> Attorney Kirrane said that he recommended to his client to perhaps to install a fence around <br /> the units or some kind of arborvitae. Mr. Goldstein mentioned that because of the flood <br /> zone, the units need to be above elevation 12,but this is not a zoning issue. <br /> Mr. Furbush commented that some bind of screening be installed. He polled the Board for <br /> comments. <br /> Mr. Goldstein made a motion that the Board approve the Special Permit request for 164 <br /> Captains Row for their raze and replace project with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2.
