McInnes requests Variance relief from lot coverage
under §174-33 (Setbacks from water and wetlands) of the Zoning Bylaws to allow for
construction of a detached garage on property located in an R-3 Zoning District, Map 105
Parcel 194, Mashpee, MA.
Sitting on this hearing are the four regular Board members and Brad Pittsley.
Mr. Steve Cook, Cotuit Bay Design represented the application. The project includes a one
car detached garage with a guest suite above in the rear of the property. The property is
bound by three streets, which is Waterway in the front, The Jib on the East, and Daniel's
Island Road on the West. The location of the structure will be in the rear of the property
and meets all setback requirements. The existing lot coverage is currently 12.8% and the
new structure will increase the lot coverage to 18.6%. The homeowner removed a pool that
was located in the backyard.
Steve said that he was advised by the Building Commissioner to apply with the Board
under Section 174-33 for setbacks from wetlands. He said that the entire property is in a
flood zone. The site plan depicts Popponesset Creek as 108 ft. away from the proposed
structure. The flood zone goes through the existing house. There is an NOI filing with the
Conservation Commission which is scheduled for November 17th. He mentioned that the
comments from the Board of Health required a sketch of the existing house and number of
bedrooms to match with the septic system.
The Board had a discussion regarding the request for relief from lot coverage. They
determined that there is no need for relief from lot coverage because the proposed lot
coverage is under the 20% requirement.
Sharon read the Board of Health and Conservation comments into the record.
There were no more comments from the Board or audience.
3
