mixed-use or commercial developments or projects which will <br /> involve a variance request, a copy shall be provided for review _ <br /> by the Board of Appeals. The Planning Board shall consider any <br /> comments received from the above-named officials and boards in <br /> making its decision, provided that such comments are rec i ed at <br /> or prior to the required public hearing. <br /> Special Permits shall only be- issued following a public hearing - <br /> held within sixty-five days, but not less than -forty-five . <br /> (45) days after the filing f an -application with the Planning <br /> Board r Boar.,of��Appeai s at a regr�lar r or spec1-al-_ eeting,,, a Co y <br /> y <br /> of which shall forthwith be given to the Town Clerk by the <br /> applicant after having been signed and dated b the Board, <br /> chairman. <br /> An application for a Special Pewit may be approved, approved <br /> with conditions, or denied. Conditions <br /> .may include, but are not . <br /> limited to,, requirements for traffic or pedestrian improvements <br /> required to mitigate or accomodate the impacts of the proposed <br /> use, housing for persons of low or moderate income, open space <br /> buffers or screening to mitigate off-site impacts, reduced lawn <br /> or paving areas and other measures to prevent water quality <br /> impacts, water or sewer lines in anticipation of connection to <br /> public systems within a reasonable period of time, landscaping, <br /> development phasing requirements, requirements for surety bonding <br /> to insure compliance and completion of proposed improvements and <br /> other items deemed necessary to protect the public health and <br /> safety or minimize impacts on community facilities, services and <br /> character or on neighboring properties and their occupants* <br /> Any special permit hereinafter granted shall lapse within two <br /> years from the grant thereof, or within a shorter period of time <br /> e <br /> if specified in the decision of the approval-granting authority, <br /> which shall not include such time required to pursue or await <br /> the determination of an appeal under Chapter 40A.
