Guerrera. <br /> John Slavinsky of Cape&Islands Engineering re the applicant,Dr.-5 g resented p pp Vanaria, <br /> who also attended the meeting. Mr. Slavinsky stated that i plans were submitted to the ,y <br /> ,..Y p ,r ,w <br /> Town of Mashpee n 1995. The abutting house, owned by the applicant's mother, was , <br /> not hooked to Town water. The Board of Health refused to issue permits until that house <br /> p , <br /> Y. <br /> was connected to Town water. <br /> ., <br /> In the meantime, Mr. Slavinsky stated that architectural plans were sitting at Town Hall. �. • ;a <br /> In October 1998 after Mrs.Vanaria's house <br /> was connected to Town water,it was <br /> determined that the setback requirements are 15 feet. Mr. Slavinsky informed the Board <br /> that the applicant pushed the main section of the house over to conform with the 15-foot <br /> k <br /> sideline setback requirement. Currently there is an existing foundation that conforms to <br /> e zoning by-laws. The applicant is requesting relief in order to construct the 12 x 24 <br /> rom the beginning.foot garage,which had been planned on fMr. Slavinsk <br /> y stated that ` <br /> Dr.Vanaria,had architectural plans drawn based on being told by Mr. Slavinsky that the <br /> setbacks were 10 feet on the side and rear and 2 `., 5 feet in the front. Mr. Slavinsky stated <br /> "aY permits that to build were issued before it wa p s discovered that the setback requirements <br /> are 15 feet. The garage will be 10 feet from the lot line. <br /> r <br /> Mr. Govoni stated that it was an oversight on the part of the Town departments that the <br /> _ 15-foot setback was not discovered until after the applicant had plans drawn.` � <br /> b Mr. Hauck informed the Board that a two foot overhang of a deck is permissible. <br /> No comments were received from abutters. 4 } <br /> Mr. Guerrera moved to grant a Variance of 5 feet of the sideline setbacks for the garage r�l <br /> and a Variance of 1.8 feet for the projected overhang of a second-floor deck. Subject to f <br /> criteria: 1 —4 and findings: 4. Mr. Regan seconded. All agreed. <br /> Gary&Zaida G.
