Board Members resent were C <br /> p Chairman Edward <br /> M. Govoni,Vice Chairman James E.Regan III and Associate Member Richard <br /> Guerrera.B T.Board Member Robert G.Nelson .'�n and Associate Members James M. Dorgan # ' <br /> and Michael A. Makunas were absent.Local Inspector Russell W. Wheeler �was <br /> attendance. <br /> Bruce A.„&Lisa M. Oakley: Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the sideline setback requirements on roe 1 <br /> an R-3 zoningq p p �y ocated district at 146 Avenue(Map 69 Block 170}, p Mash ee MA <br /> IT` <br /> S <br /> Members sitting: Edward M. Govoni, James E. Regan III and Richard T. Guerrer j"` <br /> Ms. Lisa Oakley represented her application and stated that the plans include i r p ude converting <br /> the existing garage into a family room and attaching a two-car to family garage y room. <br /> The 22 x 22 foot garage will be constructed on the west side of the ro ert <br /> p p y abutting a f <br /> vacant lot and will require a two-foot variance from the setback requirements. Ms. <br /> „ <br /> Oakley stated that a soil test was do ne to make sure there are no excavation problems on <br /> the site. She also submitted a title search information packet aloe withpictures <br /> house. p g of the <br /> Ms. Oakley submitted a letter from an abutter,Mary A. Clinch,who has no object'� ion to � ►� ,� � . <br /> the proposal. The Board also received a letter from an abutter,Martha Love who <br /> expressed approval of the project. <br /> Ms, Oakley said they wish to expand in order to accommodate large family gatherings. <br /> The would also like to gain access g <br /> Y g s to an attached garage for safe reasons. <br /> safety <br /> Ms.Etheleen Antunes questioned if the owners of the vacant lot had been notified and r 'the , <br /> Board secretary assured her that they had been. Ms.Antunes also questioned why <br /> y the 44 <br /> Oakleys are exempt from the subdivision. Ms. Oakley stated. � . . y that it was because Ms. <br /> Antunes filed her special permit subdivision in December 1993, four months aver the <br /> Oakleys built their home in August 1993. The Board members examined the title search <br /> documents. Mr.Regan questioned when the lot had been assessed as a distinct lot. Ms. <br /> Oakley informed him that it was recorded in 1993. <br /> , Er <br /> Mr. Govoni stated that a subdivision can be recorded before the restrictive covenants are <br /> recorded. After examining the documents submitted by Ms. Oakley,he stated that the <br /> subdivision was recorded in 1992. However,the restrictive covenants were recorded in <br /> a 1994. Mr. Guerrera and Mr. Govoni asked Ms.Antunes if she was opposed to the request <br /> I <br /> T �f �- <br />
