Govoni, James E. Regan III and Richard T. Guerrer j"` <br /> Ms. Lisa Oakley represented her application and stated that the plans include i r p ude converting <br /> the existing garage into a family room and attaching a two-car to family garage y room. <br /> The 22 x 22 foot garage will be constructed on the west side of the ro ert <br /> p p y abutting a f <br /> vacant lot and will require a two-foot variance from the setback requirements. Ms. <br /> „ <br /> Oakley stated that a soil test was do ne to make sure there are no excavation problems on <br /> the site. Ms.Antunes also questioned why <br /> y the 44 <br /> Oakleys are exempt from the subdivision. Ms. Oakley stated. � . . y that it was because Ms. <br /> Antunes filed her special permit subdivision in December 1993, four months aver the <br /> Oakleys built their home in August 1993. The Board members examined the title search <br /> documents. Mr.Regan questioned when the lot had been assessed as a distinct lot. Ms. <br /> Oakley informed him that it was recorded in 1993. <br /> , Er <br /> Mr. Govoni stated that a subdivision can be recorded before the restrictive covenants are <br /> recorded. After examining the documents submitted by Ms. Oakley,he stated that the <br /> subdivision was recorded in 1992. However,the restrictive covenants were recorded in <br /> a 1994.
