The <br /> Planning Board suggested that the applicant seek a Variance from the- Board of Appeals. + . <br /> Attorney watt also stated that whatever is done on the lot includingaccess to the lot,will <br /> require a Special Permit from the Board in the fixture. Ix y <br /> r <br /> Mr. Govoni asked the applicant what his plans are for the lot. Mr. Fratus indicated that ! � <br /> he had no specific plans. Mr. Govoni also asked what the setback r ' "{equirements in a�-2 <br /> i <br /> zoning district are. He was informed that t is 75 feet. Mr. wheeler said the e applicant <br /> will need Variance relief from the 75-foot setback requirements from �'q the paper road <br /> (Oakwood Road and Route 130. <br /> Attorney Watt said that the applicant is scheduled to appear before the Planning "�4. pp Board in <br /> g <br /> March. He stated that the Planning Board would require the construction of a road of at a ;' <br /> least 200 feet in order to comply with the zoning requirements. If the Board grants the <br /> Variance,the Planning Board may waive the building of the road. F <br /> Mr. Govoni suggested that the applicant receive approval first from the Planning Board to ' <br /> 4+ r <br /> combine the three subject lots, along with the road, into one lot. He also suggested " <br /> determining the definitive footprint so the Board of Appeals will hav <br /> e ve specific figures to � 1 <br /> z work with in order to grant the Variance. <br /> x Mr.Fratus stated that after reading the By-laws, if a lot is on a corner, it must have �' ` <br /> setbacks of 75 feet from both roads,which leaves very little for him to build on. Mr. <br /> Govoni assured Mr. Fratus that the Board has granted relief in the past to applicants who <br /> � P pp <br /> sought to develop on lots abutting two or more roads. <br /> V <br /> 1 <br /> Mr.Regan questioned how long Mr.Fratus has owned the three lots. Mr. Fratus stated F <br /> that he purchased the lots over a year ago. t <br /> Mr. Govoni questioned if the Board has the authority to remove a road from a Land Court <br /> P � <br /> M <br /> Plan. r. Regan expressed concern about technical rights that owners in the subdivision� <br /> y might have with regards to the approved paper road and the subdivision. They also suggested that the ►', <br /> applicant then return to the Board of Appeals with a footprint with all the Variance " <br /> requests. } <br /> Mr. Govoni stated that a letter will be composed for the applicant stating <br /> p pp g that the Board <br /> has no problem granting the Variance, but wants the applicant to receive Planning Board . , <br /> approval before the Board of Appeals proceeds. ; ? <br /> Mr. Govoni moved to continue the hearing until March 10, 1999.
