Board Members resent were C �". p Chairman Edward <br /> M. Govoni, Vice Chairman James E. Regan III and Associate Members Richard T. ' <br /> Guerrera and James M.Dorgan.g Board Member Robert G.Nelson was absent. Building <br /> Commissioner William F. Hauck was in attendance. <br /> James R. &Anne L. Collins: Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to v • <br /> Y p any the yard setback requirements on property located in <br /> an R-3 zoning district at 6 Rock Island Road(Map 123 Block Mash 21), ee MA. <br /> � p � <br /> t , <br /> James R. &Anne L. Collins. Request a Special Permit under Section 174-20 of the <br /> Zoning By-laws for permission to demolish an existing house and construct a new <br /> three-bedroom home on property located in an R-3 zoningdistrict at 6 Rock ck Island <br /> Road(Map 123 Block 21),Mashpee,NIA. <br /> Members sitting:Edward M. Govoni, James E. Regan and James M. . <br /> Dor an /t <br /> g , <br /> I <br /> ii. <br /> Mr. John Slavinsky of Cape&Islands Engineering represented the applicants,Mr. and , <br /> pp � �4 <br /> Mrs. Collins, who also attended the meeting. Mr. Slavinsky submitted new plans and <br /> stated that the Variance sought will be changed to 8 feet,rather than 10 feet from the <br /> sideline setback due to the placement of the chimneyon the other side .of the house. He 1 <br /> also submitted photos of the 1950's style cottage that will be demolished. Mr. Slavinsky <br /> stated that the property has an existing cesspool that will be pumped out and filled. A, ►�'�� <br /> new Title V septic system will be installed. The Board of Health has granted the <br /> applicants a Variance of 6 feet on the placement of the new septic system. Mr. Slavinsky } <br /> said that there is a designated reserve area as required by the Conservation Commission. '� ' �1. �'F <br /> Mr. Slavinsky stated that Rock Island Road is an easement. Mr. Regan questioned when <br /> the s <br /> q �subdivision was created. Mr. Slavinsky replied that it was established prior to zoning. •�'i <br /> Mr. Slavinsky said he was unsure exactly what Variance figures to request since Rock "�. .r . <br /> Island Road is an easement. <br /> J , <br /> Mr. Govoni stated that there are no zoning requirements in this particular case. <br /> Theoretically,he said that the applicant does not need Variances. Mr. Hauck confirmed '� { <br /> that the subdivision was established prior to zoning, so there are no setbacks. <br /> ' <br /> p g� ks• <br /> Howe <br /> ver, Mr. Hauck said that he does not issue permits closer than 30 feet in the front <br /> and 10 feet on the sides. Mr. Govoni also stated that it would be wise to grant Variances f Ix E <br /> k <br /> .` according to current zoning by-laws.
