Mr. <br /> 4 <br /> stated that Conservation Agent Robert Sherman has been unable to visit the site ' � <br /> -. due to <br /> i, <br /> the bad weather. 4, <br /> Mr. Dorgan questioned if the Board can grant the Variance before the Conservation <br /> Commission has approved the location of the proposed house. Mr. <br /> ■ p p Govoru questioned if <br /> Conservation will alto - '{w 3 5 feet to the house and not to the work limit area. Mr. Govoni <br /> stated that it is difficult for the Board to grant a Variance without knowing g the exact <br /> location of the house. 1 <br /> t�� • y <br /> Mr• Sanicki stated that there is no other option. He further p stated that the Conservation <br /> t <br /> Commission has recognized the difficulty with the site. The Board of Healt <br /> h has granted �. <br /> a Variance on the septic system. A denitrification system will be installed. <br /> n <br /> Mr. Dorgan stated that the Wetlands Act law requires the applicant to get approval from <br /> pp <br /> the Conservation Commission before proceeding t� p g o other Boards. He said that the Board <br /> cannot overrule Massachusetts's law or the Wetlands Act. <br /> Mr. Sanicki indicated that Mr. Sherman was going to call Cynthia and suggest that the t <br /> gg <br /> Board grant the Variance with the following condition: "upon concurrence of '`tk;� li <br /> �3,3 p the <br /> wetlands by the Conservation Commission and i 'f there is any deviation m.that wetlands, <br /> we will get back to the Board of Appeals". <br /> Mr. Sanicki confirmed Mr. Govoni's questions regarding the setback Variances being <br /> *., <br /> g t <br /> ' sought: 15-foot setback from the wetlands and 10-foot front setback. ' <br /> z..� 1 �f� <br /> � 7 <br /> Mr. Govoni stated that he didn't see an problem with the y p Board granting the Variance. � �t <br /> He said that if there are any changes the applicant would have to reapply. <br /> Mr. Govoni read a letter from an abutter,Ms. Carla Meskill who '�I o lives�n New York. She <br /> expressed concerns regarding the following: <br /> • the close proximity of the proposed septic s stem to the abutting pro �Y • <br /> • construction on the subject property with its steep slope will cause erosion of •�. }°�- a <br /> Cata uin Pond and abutting wetlands.
