Capo Certificate of Title: 34148 <br /> 181 Wheeler Road Lot#: 30 <br /> (Map 49 Parcel 45) Book#: 267 Page#: 38 <br /> Mashpee, MA 02649 <br /> A Petition was filed by Noreen T. Capo on April 3, 2015 requesting a Written <br /> Finding under Article V §174-17 to allow for construction of a 12' x 16' deck located on <br /> property located in an R-5 Zoning District, (Map 49 Parcel 45), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 17, 2015 and April 24, 2015 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on May 13, <br /> 2015 at which time the following members of the Board of Appeals were present; <br /> Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Clerk, Ron Bonvie, and <br /> Associate Members, Dom DeBarros, and Scott Goldstein. <br /> Ms. Noreen Capo, homeowner, presented the Board with a plot plan requesting to <br /> build a 12' x 16' deck next to her existing sunroom. The existing lot coverage is 11.1% and <br /> the proposed lot coverage is 12.8%. There will be a stairway built off the rear of the deck <br /> facing toward the rear of the back yard. <br /> Mr. Furbush read the Inspection Department comments into the record; "the area is <br /> zoned R5 and the property is in the Pre-contact Archaeology Sensitivity area — listed as <br /> "High Sensitivity". The Board gave the applicant the contact information regarding §174- <br /> 24 C (3). <br /> GENERAL FINDINGS: <br /> The subject property located at 181 Wheeler Road is approximately 11,250 square <br /> feet. <br /> There were no abutters present. <br /> 1 <br />
