Moskowitz Land Court Lot#: 52 <br /> 146 Popponesset Island Road Plan#: 11408-12 <br /> (Map 112 Parcel 10) <br /> Mashpee, MA 02649 <br /> A Petition was filed by Michael Moskowitz requesting a Minor Modification <br /> (Finding-2014-37),to rebuild the garage foundation on the same footprint to accommodate <br /> 591 sq. ft. of living space above the garage on property located in an R-3 Zoning District. <br /> Assessor's Map 112 Parcel 10, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 22, 2015 and May 29, 2015 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 10, 2015 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, Richard Jodka, and Dom DeBarros, and Associate Member Scott <br /> Goldstein. <br /> Mr. Moskowitz represented himself stating the Board approved a garage addition <br /> back on August 27, 2014 and at that time he did not realize that a new foundation was <br /> required. The foundation was not deep enough. The plan is exactly the same and the garage <br /> foundation is in same location. He is not starting construction until the fall. <br /> Mr. Furbush spoke to the Building Inspector and determined it is a minor <br /> modification. <br /> Mr. Bonvie read the Board of Health Comments into the record; "The BOH <br /> approved the setback variance back in August 2014 with the condition that a septic <br /> inspection be done which it has and that a 40 mil membrane be placed on the foundation <br /> as mitigation for the variance. The building pen-nit will be amended accordingly." <br /> 1 <br />
