Winslow <br /> request a Variance under §174-31 of the Zoning By-laws for relief from frontage and lot <br /> size requirements to deem lot buildable on property located in an R-5 Zoning District,(Map <br /> 71 Parcel 89-0-R), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on August 7, 2015 and August 14, 2015 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 26, 2015 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ronald Bonvie, Richard Jodka, and Dom DeBarros, and Associate <br /> Member Scott Goldstein. Also present was Building Commissioner, Michael Mendoza. <br /> Attorney, Kevin Kirrane represented the applicants for the Variance request. He <br /> introduced Mr. Alan Winslow who was the previous owner of the lot and a member of the <br /> Winslow family who had owned the property before it was sub-divided. Mr. Kirrane <br /> supplied the Board with a copy of the sub-division plan, an assessor's map, and various <br /> deeds relating to the title of the lot and the adjacent lot. The lot is deemed not buildable at <br /> the present time. <br /> The property was sub-divided between 1985 and 1986. During this period of time, <br /> there was a great deal of development taking place in the Town of Mashpee. The <br /> preliminary sub-division plan was filed when this area zoning was sectioned into 15,000 <br /> square foot lots. Between the time the preliminary sub-division was filed in November of <br /> 1985, and the time the definitive plan was approved by the Planning Board in April of <br /> 1996, the zoning changed from 15,000 sq. ft. to 40,000 sq. ft. <br /> 1 <br />
