Spilios,II requesting a Special <br /> Permit under §174-25.I (9) of the Zoning Bylaws for an existing dock, ramp and float in <br /> an R-3 Zoning District, (Map 125 Parcel 11), Mashpee, MA. (Mass DEP License #5747 <br /> was never recorded with Barnstable Registry of Deeds). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on October 30, 2015 and November 6, 2015 <br /> a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 18, 2015 at which time the following members of the Board of <br /> Appeals were present and acting on this hearing; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Richard Jodka, Dom DeBarros, and <br /> Associate Member, Scott Goldstein. <br /> Mr. Paul Doran, Professional Engineer represented the petitioner. He was in fiont <br /> of the Board twenty two years ago for the special permit for the dock, ramp and float <br /> granted to Plato's grandparents under the Amnesty Program through the Mass DEP under <br /> Chapter 91 Waterways Program. The Special Permit was issued by the Zoning Board of <br /> Appeals on September 21, 1993. The dock has not changed since 1994 and is in the same <br /> footprint as noted.on the site plan. At the time, there was one condition issued by the <br /> Conservation Commission was removal of the extra float; everything else remains the <br /> same. <br /> Mr. Spilios reapplied to the Zoning Board because his grandfather passed away <br /> before filing the special permit with the registry of deeds, and it expired within 60 days. <br /> Mr. Goldstein asked if the harbormaster was notified. Mr. Spilios delivered the <br /> application personally to the harbormaster. The float needs to be identified with black <br /> lettering as indicated by the DEP. <br /> 1 <br />
