Obrinsky Doc. #: 660735 <br /> 222 Wheeler Road Ctf. #: 140033 <br /> (Map 49 Parcel 23) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 5, 2015 by Owner, Robert W. Obrinsky <br /> requesting a Variance under §174-28 and §174-31 of the Zoning By-laws for relief from <br /> lot size and frontage requirements to deem lot buildable on property located in an R-5 <br /> Zoning District, 222 Wheeler Road, (Map 49 Parcel 23), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on November 20, 2015 and November 27, <br /> 2015 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 9, 2015 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ronald Bonvie and Richard Jodka, and Associate Members Scott <br /> Goldstein,Norman J. Gould, and Brad Pittsley. <br /> Mr. Kevin Kirrane represented the applicants for the Variance requests for 222,223, <br /> 227 and 231 Wheeler Road. He provided the Board with a narrative of the petitions, and <br /> photographs. The petitions were separately advertised because they are owned by different <br /> members of the Obrinsky family. <br /> The 222 Wheeler Road shows the area is largely wooded on Ashumet Pond. This <br /> stand-alone lot has 14,700 sq. feet and 75 ft. of frontage on Wheeler Road. Mr. Kirrane said <br /> the Board is well aware this lot is situated in the R-5 Zoning District, and as a result, had a <br /> number of changes to the bylaws during the late 80's and early 90's, which currently <br /> requires 80,000 sq. ft. and 150 ft. of frontage in order to be a buildable lot. <br /> 1 <br />
