Simone, Doc. #: 997166
Rebecca A. Obrinsky&Jessica L. Obrinsky Ctf, #: 176223
223 Wheeler Road
(Map 49 Parcel 35)
Mashpee, MA 02649
A Petition was filed on November 5, 2015 by Owners, Robert W. Obrinsky, Luisa
A. Simone,Rebecca A. Obrinsky&Jessica L. Obrinsky requesting a Variance under§174-
28 and §174-31 of the Zoning By-laws for relief from lot size and frontage requirements
to deem lot buildable on property located in an R-5 Zoning District, at 223 Wheeler Road,
(Map 49 Parcel 35), Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of
general circulation in the Town of Mashpee, on November 20, 2015 and November 27,
2015 a copy of which is attached hereto and made a part hereof.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee
Zoning By-laws.
Public Hearings were held on the Petition at the Mashpee Town Hall on
Wednesday, December 9, 2015 at which time the following members of the Board of
Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell,
Board Members, Ronald Bonvie and Richard Jodka, and Associate Members Scott
Goldstein,Norman J. Gould, and Brad Pittsley.
Mr.Kevin Kirrane represented the applicants for the Variance requests for 222,223,
227 and 231 Wheeler Road. He provided the Board with a narrative of the petitions, and
photographs. The petitions were separately advertised because they are owned by different
members of the Obrinsky family.
The 223 Wheeler Road shows the area is a largely wooded area across from Ashumet
Pond. This lot has 11,250 sq. feet and 75 ft. of frontage on Wheeler Road. Mr. Kirrane said
the Board is well aware this lot is situated in the R-5 Zoning District, and as a result, had a
number of changes to the bylaws during the late 80's and early 90's, which currently
requires 80,000 sq. ft. and 150 ft. of frontage in order to be a buildable lot.
1
