An article submitted by the Planning Board amending various subsections of Section 1 - <br /> 4 .1 and 1 4-46.H. in order to 1 remove references to the no-longer-existing -1-Sv and <br /> -1-0 zoning districts, remove a sentence regarding on-street parking which conflicts <br /> with the parking by-law amendments made at the October 2004 Town Meeting, 3 provide <br /> for a transfer of residential development rights into non-residential zoning districts under the <br /> standards specified in Subsections 1 - . ., 1 # ,C. through and 17446.H of the <br /> "Open Space Incentive Development SIL ) by-law, along with allowing the transferred <br /> residential units (and not any other uses) to be located in a third story, by special permit from <br /> the planning Board under the existing "commercial center' zoning provisions ofSection <br /> 1 4: 4 .1. <br /> 2. An article submitted by petition amending Section 1 4-2 .F. 3 to allow C.`automobile repair <br /> shops, provided that work is carried out within the building" in the I-1 Industrial zoning <br /> district. <br /> 3. An article submitted by petition which would amend the defmition of "street" to include <br /> `every public or private way.shown on a plan or Subdivision recorded prior to October 1, <br /> 2003, even if not approved by the Planning Board?' and stating that "`if the recorded way <br /> extends to a shoreline, them access to the water is included within that public or private right <br /> of way' . The article also creates a new Section 1 4-13.2 titled "Removal of obstructions <br /> within streets and public or private rights of way and a procedure providing for their <br /> removal"' which would provide that "a property owner, an association of property owners, or <br /> resident may file a written request with the Town for removal of one or more obstructions <br /> tions <br /> on any street ...", describes certain items which are not considered obstructions, establishes a <br /> procedure for said request through the "Zoning Officer", sets a maximum fee of for any <br /> such request, requires publication and notice to abutters within 300 feet of the Zoning <br /> Officer's decision, requires the Department of Public Works to remove such obstruction's if <br /> not removed otherwise, provides for appeal of the Zoning Officer's decision to the Zoning <br /> Board of Appeals and time limits on the appeal process, provides for further appeal from the <br /> Zoning Board of Appeals decision to the Board of Selectmen and sets time limits on than <br /> -.01 WV 1 V1 <br />
