CONCLUSION <br /> Based upon the foregoing, we respectfully request that the Board of <br /> Appeals reverse the Building Commissioner's determination and issue the <br /> following rulings: <br /> 1. That the Mashpee Zoning Bylaws extend below the extreme low water <br /> marls and apply to Mr. Cook's proposed aquaculture facility; <br /> 2. That Mr. Cook's proposed aquaculture facility is within an R-3 Zoning <br /> District and a Velocity Zone; <br /> 3. That Mr. Cook's proposed aquaculture facility is not an allowed use <br /> under the Zoning Bylaw; <br /> 4. Alternatively, that Mr. Cook's proposed aquaculture facility is not <br /> allowed by the Zoning Bylaw without a Special Permit under Section <br /> 174-25(C)(4) or 175-25(C)(5); <br /> 5. That Mr. Cook's proposed aquaculture facility is prohibited by Section <br /> 174-62 of the Zoning Bylaw unless he obtains a variance; <br /> 6. That Mr. Cook's proposed aquaculture facility is prohibited by Section <br /> 174-33 unless he obtains a variance; <br /> 7.
