MacLellan Lot: #154 Doc: #1102964 <br /> 403 Great Oak,Road Plan Book#35464-B (Sheet 8) <br /> (Map 126 Parcel 48) <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 3, 2014 by Alexander MacLellan requesting a <br /> Variance under §174-31 of the Zoning By-laws (Land Space Requirement) and M.G.L. <br /> Chapter 40A §10 to deem lot buildable on property located in an R-3 Zoning District at <br /> 403 Great Oak Road (Map 126 Parcel 48), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 7, 2014 and February 14, 2014 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> On February 26, 2014, Public Hearings were held on the Petition at the Mashpee <br /> Town Hall at which time the following members of the Board were present and acting <br /> throughout; Chairman, Jonathan Furbush, Vice Chairman, William A. Blaisdell, Board <br /> Members, Ronald Bonvie, James Reiffarth, and Richard Jodka, Associate Members, <br /> Domingo DeBarros and Scott Goldstein. Also present was Building Commissioner, <br /> Richard E. Morgan. <br /> Mr. MacLellan introduced himself as the property owner stating he is in the process <br /> of selling his property on 403 Great Oak Road. He stated he has owned the property for ten <br /> years hoping to build a home but did not have the resources to develop the lot during the <br /> "economic slowdown". He has a potential buyer for the lot and wants to reinstate his <br /> request for variances that expired due to non-recording at the Barnstable County Registry <br /> of Deeds when issued by the Zoning Board at the past hearings dated June 27, 2007. <br /> Mr. MacLellan provided the Board with the plot plan that was approved back in <br /> June 2007 depicting a proposed 30' x 70', (3)three bedroom dwelling situated 51 feet from <br /> the edge of the salt marsh and denitrification septic system with ultra-violet light.
