Miller, Trustee Certificate of Title: 154795 <br /> 22 Squaw Lane Realty Trust Lot#: 10, 11, 13 <br /> 22 Squaws Lane (Map 117 Parcel 84) Plan#: 11408L Block F <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 21, 2014 by Stephen G. Miller requesting a <br /> Written Finding under Article V §174-17 of the Zoning By-laws and M.G.L. Chapter 40A <br /> §6 concerning continuance, extension or alteration of a pre-existing, non-confonning <br /> structure to allow for construction of a new single family dwelling on property located in <br /> an R-3 Zoning District at 22 Squaws Lane, (Map 117 Parcel 84), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 7, 2014 and March 14,2014 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Petition was re-scheduled from Wednesday March 26, 2014 public hearings to <br /> allow for a full member Board. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 9, 2014 at which time the following members of the Board of Appeals <br /> were present and acting throughout; Chairman,Jonathan Furbush,Vice Chairman,William <br /> A. Blaisdell, Board Members, James Reiffarth and Richard Jodka, and Associate Member <br /> Scott Goldstein. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Tom Bunker, BSS Design represented the Petitioner for the raze and replace <br /> project. He stated the project was approved by Conservation Commission and received an <br /> Order of Conditions. The house is located on the South end of Squaws Lane and fronts <br /> Nantucket Sound in the Popponesset Overlay District. The lot is non-conforming at 14,400 <br /> square feet, and has a 30 foot setback in the front of the garage, a 7 foot setback on the <br /> sides and a 23 foot setback on the water side property line. The existing structure is 3,065 <br /> square feet with 21.3% lot coverage. The velocity zone is 17 (elevation 15 and 13). The <br /> proposed new four bedroom home will be the same foot print. It will be approximately 30 <br /> feet of the average grade and moved back 2 to 3 feet from the shoreline with new dune <br /> vegetation plantings. The stone water will be trapped with drywells and the structural <br /> engineer will design the footings for the proper foundation on piers. <br /> 1 <br />
