Schmitt (Owner of Record) <br /> 37 Seconsett Point Road <br /> (Map 124 Parcel 19) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 31, 2014 by Robert Roche requesting a Written <br /> Finding under Article V §174-17 of the Zoning By-laws and M.G.L. Chapter 40A §6 <br /> concerning continuance, extension or alteration of a pre-existing,non-conforming structure <br /> to allow for construction of a new single-family dwelling on property located in an R-3 <br /> Zoning District at 37 Seconsett Point Road, (Map 124 Parcel 19), Mashpee, MA. (Owner <br /> of Record: Patricia O. Schmitt). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 4, 2014 and April 11, 2014 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, April <br /> 23, 2014, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck <br /> Road North. Board Members, Jonathan Furbush, William A. Blaisdell, James Reiffarth, <br /> Richard Jodka, Associate Members Domingo K. DeBarros and Scott Goldstein were <br /> present and acting throughout. Building Commissioner,Richard Morgan was also present. <br /> Attorney, Brian Wall represented the applicants who were present as well as Mr. <br /> Borselli, of Falmouth Engineering. Ms. Sclunitt's son was also present. The request for a <br /> Written Finding under Section 174-17 of the zoning bylaw seeking permission to raze the <br /> existing structure and replace it with a new structure. The 8,700 square foot lot is relatively <br /> small in an R-3 zoning district on Seconsett Point Road and backing up to Waquoit Bay. <br /> The lot has been in existence since 1928 and is therefore non-conforming. <br /> 1 <br />
