DiMeo, Trustees, <br /> requesting a Variance under §174-33 of the Zoning By-laws for setback relief from water <br /> and wetlands to allow for a deck expansion as defined by MGL C 131, §40 on property <br /> located in an R-3 Zoning District at 5 Compass Circle, (Map 105 Parcel 260), Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 16, 2014 and May 23, 2014 a copy of <br /> — which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 11, 2014 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush,Vice Chairman,William Blaisdell, Clerk,Ron <br /> Bonvie, Board Members James Reiffarth and Richard Jodka, Associate Member Scott <br /> Goldstein. Also present was Building Commissioner, Mr. Richard Morgan. <br /> Mr. Louis DiMeo representing himself stated he presented his application for the <br /> pool deck expansion in front of the Conservation Commission and after speaking with Mr. <br /> Morgan, suggested Mr. DiMeo meet with the Zoning Board of Appeals. He and his wife <br /> Louise purchased the home two years ago, and the pool was installed by the previous <br /> owner. He stated there's a two foot wall that aligns the pool facing the ocean. Inside the <br /> pool is a seat that is only two feet below the water line, and when anyone gets out of that <br /> seat,it's very dangerous to step out and walk along the ledge because it's very narrow and <br /> he's concerned for his family's safety. <br /> 1 <br />
